Code of practice update for UK sponsored skilled workers

The UK Border Agency has release a quarterly update on the codes of practice for sponsored skilled workers under the points-based system.

Employer Sponsorship Licence

The UK Border Agency has released a new code of practice for those hiring Tier 2 workers with an Employer Sponsorship Licence.

If an employer wants to sponsor a migrant worker from outside Europe under Tier 2 or Tier 5 (creative and sporting category only) of the points-based system, they must use the codes of practice to:

  • Check the skill level and appropriate pay for that job; AND
  • Find out where the job must be advertised in the UK before it can be offered to a migrant worker.

All UK employers wishing to hire an employee from outside of the European Union must have an Employer Sponsorship Licence.

Once an Employer Sponsorship Licence is obtained, it is possible for a business to employ needed staff through Tier 2 Work Permit stream provided the codes of practice are adhered.
