American Non-immigrant K3 Visa

A K3 Visa is a temporary Non-immigrant Visa which allows a foreign spouse of an American citizen enter America as a temporary resident and adjust to immigrant status while in America.

Previously, the foreign spouses of American citizens and their children who were the beneficiaries of pending or approved visa petitions could only enter America using an Immigrant Visa. The K3 Visa allows the foreign spouse and children to live and work in America while their petition is being processed for permanent resident status.

To be eligible, you must:

Be married to an American citizen;
Be in a genuine and lasting relationship;
Be travelling to America for the purpose of joining your husband or wife, and to await the approval of the petition and subsequent lawful permanent resident status; and
Have filled out the necessary documentation and forwarded it to the appropriate American Embassy or Consulate abroad.
