Off-list state nomination - get a 'free kick' at an Australian skilled visa

Earlier this year, the Australian Government released 4,000 off-list nominations nationwide, which are informally known as 'free kicks'. The off-list nominations are divided equally between the six states and two territories that make up Australia, with each state and territory given 500 of these places to help provide Australian skilled visas and fill gaps in the skilled workforce.

What are 'free kicks'?

Each Australian state and territory has a list of occupations that they can nominate for an Australian Skilled Sponsored Visa (subclass 176) or a Regional Sponsored Visa (subclass 475). Previously, the states and territories were restricted to only being able to nominate occupations on these lists, but with the introduction of off-list state sponsorship, they now have the freedom to nominate 500 'off-list' skilled workers a year.

These 'free kicks' give every state and territory the ability to nominate a certain number of off-list skilled workers for an Australian skilled worker, although the worker must still have an occupation listed on the Skilled Occupations List (SOL).

How are these 'free kicks' allocated?

Applications for the 500 free kicks are assessed on an individual basis, and each state is free to set their own criteria. The 100 point pass-mark on the Australian visa points test still has to be reached for the permanent visa, but it is now possible to be nominated in an occupation that is not listed as in demand.

Importantly for the Australian skilled visa applicant, the state or territory nomination means a quicker route through the immigration process at a time when many migrants have had their general skilled migration applications pushed to the bottom of the pile.

What is the attitude of the various Australian states and territories to 'free kicks' and off-list state sponsorship?

Each state and territory has approached the off-list state sponsorship differently. Western Australia is one state that has a proactive policy towards the off-list nomination initiative, being enthusiastic and transparent in its approach.

Visa Bureau spoke recently to Genelle Surace, a senior migration officer from the Western Australian Government, who helped answer some questions about their policies towards off-list nomination.

Western Australia is one state which is embracing
off-list state nomination as a "fantastic tool".

What has been Western Australia’s policy towards the 500 off-list nomination initiative?

Genelle Surace: "Western Australia has always had a very open policy towards migration, and this is reflected in our attitude towards the off-list nomination. The off-list nominations are a fantastic tool to attract people to Western Australia, who may not be on our list for State Sponsorship, yet still have skills and experience that are sought after by Western Australian employers. It also allows people who have family in Western Australia to apply for State Sponsorship, and under the current guidelines for priority processing from DIAC, have their visa applications processed."

WA has the fastest growing population than any other state – could this be a result from a more aggressive approach to skilled migration?

Genelle Surace: "Part of the answer to this is attributed to our migration promotions, but with an enviable climate, great job opportunities and long term prospects, Western Australia is a great all-round choice for people to start their new lives in Australia."

Has WA had a good response to the off-list nomination, and has it been encouraged to nominate skills that are not found on the Critical Skills List to give other skilled migrant hopefuls a chance?

Genelle Surace: "Western Australia has had a good response to the off-list nomination, and is nominating occupations that are not on the Critical Skills List (CSL). When assessing an application for off-list nomination, greater consideration is given to applicants who:

  • Have a job or offer of employment in Western Australia in a SOL occupation (must be related to the nominated occupation);
  • Have established links to the State – having lived, studied or have support in Western Australia;
  • Demonstrate that their occupation is in demand in Western Australia; OR
  • Are prepared to live and work in a regional area of the State.

Off-list nominations will be assessed on a case-by-case basis and the ability of the applicant to meet Western Australia’s workforce skill shortages."

However, while Western Australia have taken a very open, positive attitude towards off-list state nomination, the case isn't the same for all states and territories.  Look out for a follow-up blog in the next few days where we discuss the attitudes of the other states and territories and the reasons why some choose not to use their 500 'free kicks' at all.

praise the lord
i red the recent DIAC article for some changes on the skilled sponsored visa,not only that,fees and IELTS TRF,its going to start coming july 1st 2009 onwards.is it going to effect or not those you are applied before july 1st.
because i completed my medical and PCC for 475 SKILLED REGIONAL SPONSORED.medical also finalized by DIAC.it will effect me.

this is amala dass somu.i hope you are fine.almost 70days over,so far there is no message from DIAC.i applied on 8th may'09/medical,PCC i submitted through my agent.my visa subclass is 475 skilled regional sponsored visa.
how long more i have to wait for my 'CASE OFFICER" as you advised me they start 2nd week of july.isn't it?mr tony i am waiting for your valuable reply.

The 475 State sponsored visa has exactly teh same high-priority as the 176 Stste sponsored visa. Consider instructing your agent to send a PLE on your behalf enquiring as to the status of your application. You should have a casee officer by now.

i am hemant patel paper loged applicant 30 AUGEST-2007 subclass-496 from Baroda,Gujarat in INDIA. i completed my medical & pcc in december08 also job inquiry done by my case officer but still i am waiting for my result. i have western austrealia state regional sponcership
as per new priortiy rules 1january-09 i am coming to under second catagries for state &
territory sponcership so why still they not declared my visa result .

The 496 visa was sponsorship from a relative not a State. Assuming you did apply for the old State sponsorship visa, which is a 495 visa. The old 495 visa woudl have a high priority and would be processed as quickly as possible. I would recommend you send a PLE to see what the hold up is - it may be a security check tha tthe yare waiting on.

The States have different criteria for their off-list allocations - some are not participating with it at all. Queensland have certain criteria which can be found here:

i am realy very sorry i apply for sub class -496 i mention wrong
i was already send PLE my agent through but in PLE answer they told me i am
not in CSL , EMPLOYER SPONCER & STATE SPONCER , but i have western austrelia
state regional sponcership so my agent send my state sponcerhip agreement letter
to Manager of Adelaide Processing Center but still 21day left not any reply
i am very confuse about my file , everything done but why they hold i dont understand .
plz guide me .

As long as you had WA Regional sponsorship approved before you applied in August 2007, then your case should be being processed now as a subclass 495. you should have completed a Form 47SK as well as having the WA Regional sponsorship approved back in August 2007. The subclass 496 is sponsorship by a relative who lives in a designated area and the application form for that is 47ST - I hope you did not fill out that form in error. Do you have a relative living in a designated area ?

i have not any relative in designated area so thats why
my MARA Agent get WA reginoal sponcership sub class 495 before Augest 2007 and then
after he submeet my file in DIAC on 30 Augest 2007.so i dont understand
why DIAC not issue my visa . everthing will be done and waiting for last
6 month but why ?

It must be the security check holding up granting of your visa if the employer check has been completed. DIAC shoudl respond to your Agent's PLE - get him to send another.

my job inquiry (employer check)has been completed in january-2009 .then after they hold i dont understand . one more thing what is the security check , that i dont understand . i was already send to PLE in June -09 to DIAC but in reply they told me i am not in first 3 catagories but i have WA regional state sponcership why they reply me like this .

There are only 3 priorities for the Provisonal Skilsl visas and yo uare priority number 1 - state sponsored. In the Minister's Direction, it also states that a 176 State sponsorship would not be given priority over a 475 State sposnorship and vice versa. So you must reply to the erroneous PLE response along the above lines.

is it possibal to Western Austrelia SMC Center not
inform about my state sponcership to DIAC by form -1100 & I think
without confirmation of sponcership DIAC not able to process visa
application .only they just issue me sponcership .Thats why in PLE they told me i am not coming in CSL,EMPLOYER SPONCER & STATE NOMINATION .suppose this mistake create by SMC Center now what is next step ,i inform SMC center as per your instruction so then after how much time DIAC taken to grant my visa.

is it possibal for center create mistake like this

A Security check can be a quick check with the Australian Intelligence service or it could also require referral to na overseas agency which takes much longer.

It is possible that WA never received advice of your file number and are still waiting for this before sending the form 1100 to DIAC. Best get WA to confirm it has been sent and maybe re-send.

Dear Tony

I applied for a 176 family sponsored visa in Jan '08 (market research analyst). I have also sent in my meds and PCC a few months ago, though there has been no movement of my file. It has been 20+ months already, and it seems as if non-modl will never get looked at as per current priority processing guidelnes and new ss and csl applications being received. Could you kindly advise what your understanding of GSM family sponsored stream is, and what diac intends to do with the back log? Appreciate your help on this one...

It could be some time before your application is processed but things may speed up for cases like yours as the economy improves in Australia and/or the points test is changed and less new applicants qualify.
