Australian visa priority processing and reactions to DIAC's latest announcement

DIAC recently announced changes to the Skilled Migration programme, and specifically the order in which visa applications will be processed. This announcement came following the introduction of the Critical Skills List (CSL) in December 2008, a new list of occupations which is designed to be responsive in fulfilling the needs of the Australian economy and which has been used to determine the priority of applications since January 1st, 2009.

As a result, the current order of applications is as follows:

  1. Applicants for state or territory Government sponsored visas (i.e. Skilled State Sponsored subclass 176 and Skilled Regional State Sponsored 475 visa applications);
  2. Applicants with occupations on the CSL;
  3. Applicants with occupations on the Migration Occupations in Demand List (MODL);
  4. All other valid visa applications.

Why has DIAC introduced this process?

The current global economic climate is likely to have had some influence, and for some time now the Australian Immigration system has been under pressure to reduce the number of immigrants entering the country. This is despite still needing migrants in order to fulfil a variety of occupations which are still in demand in various areas of the country.

In short, I think the case is that the Minister for Immigration and Citizenship has been compelled to show the country that they are assisting with fulfilling the skills shortages in certain areas and in certain occupations. It seems to be very much a political and economic move, and to what degree this will become effective in real terms is as yet unclear.

How should I take this news?

While the message of this notification might immediately appear daunting to some visa applicants, I think it's important that we establish exactly what it means. The notification itself seemed confused and had some errors; for example, a subclass 175 visa was listed under the heading of 'state sponsored visas', when the defining feature of a subclass 175 is that it is completely independent and does not require any kind of sponsorship.

Additionally, while DIAC have specified February 13th, 2009 as the date by which all state sponsored visa applications will be allocated a case officer, DIAC (like any government organisation with large-scale admin responsibilities) is prone to slipping on deadlines.

However, I can appreciate that many applicants will remain curious as to how this announcement will affect them and their application. With this in mind, I'd like to give my own opinions as to how I think applicants for the various skilled migrant subclasses should react to this news.

State 176 / State 475 visa applicants who have already lodged to DIAC

If you have lodged your State 176/475 visa application, then by this announcement, your application should be allocated to a case officer by February 13th. However, we do not know to what limit this extends to; for example, we're still not sure if people who lodge their applications in early February will be included in this wave of processing, or even if that priority allocation will continue past February 13th.

Also, if you do not hear back about your application by this time, it doesn't necessarily mean that yours is not included in this wave of processing, just that it may still be placed into a queue before being assessed.

All other skilled visa applicants who have already lodged to DIAC

If you have lodged an alternative kind of visa, then according to this announcement, your application will not be allocated until the state applications are dealt with. I must stress that until some time has passed and we can begin to see patterns and trends in how applications are processed and whether these new rules seem to be adhered to, Visa Bureau cannot give any solid timeframes or confirm whether your application will be affected - you may well find that it won't be.

Visa applicants who have yet to lodge to DIAC

If you are yet to submit your application to DIAC, I would advise that you aim to lodge your application with as little delay as possible. As with every application, it is preferable to lodge as soon as you can in order to allow for the best chance of avoiding any potential delays or changes.

It may be possible that you would prefer to lodge a State Sponsored subclass 176 visa, as opposed to the subclass that you are currently applying for (provided your occupation is on the Priority Skills state list for the state which you are intending to migrate to).

It's also important to understand that this is an extra aspect to the application, and in some cases can require additional fees and paperwork to be submitted, not to mention the fact that you will be under the moral obligation to live within your sponsored state for the first 2 years of your migration to Australia.

Additionally, it may prove unnecessary to switch to a state sponsored visa, should the announcement not result in delays or be as restrictive as it initially seems. Once again, it's worth remembering that DIAC timeframes are not always entirely accurate, meaning that allocation for non-state sponsored visa subclasses could continue as normal (or that regular allocation will begin again following the February 13th deadline).

In the meantime, I'd like to assure all our clients that Visa Bureau is in constant contact with the Migration Institute of Australia (MIA) and we will ensure to inform them immediately upon receiving any updates regarding this situation. It's still very early days, and further clarification from DIAC regarding a number of highly pertinent points will be required before we'll know what the true ramifications will be.

We can calculate from last years stats that DIAC must be processing a few hundred visas a day. With a quota of appx 10,000 applications for all state sponsorship, this means they could potentially get through all state applications in one month, and then hopefully start on CSLs. This is not taking into account that we are actually half way through the year and so many state applications will have already been issued. Whilst there are tens of other factors affecting these figures, this observation may provide a little relief to some knowing that there will not be an infinite stream of State sponsored applications.

Thank you Laureen for your useful insight on the possible effects of the new processing priorities. I am an onshore applicant (subclass 885), not on any of priority lists and am finding this long and now uncertain wait truly agonising. I think it unfair to club onshore and offshore applications together in processing. Onshore applicants have undergone more pains and have demonstrated their use to the Australian economy, be it in terms of study or work. And I think they deserve some credit for it. Because of some idiots onshore who tried to rort the system, now all onshore applicants are being penalised.

I think that's a very unreasonable comment to make. I've been in this country for 5.5 years and my only option was an offshore visa application. I am not on the CSL or MODL list and find the new changes annoying as it will more than likely further delay my application but I'm happy for everyone who gets their visa granted because obviously we are all wishing to stay in this country. Don't forget that all applications require the same amount of 'pain' to go through.

I applied for 475 on 11 Jan 08 and uploaded all docs + medicals + pcc. Medical + PCC have expired in Jan 09. But still don't have a case officer. My occupation is Marketing Specialist for which sponsorship has now been stopped by South Australia. I am wondering why I am not getting a case officer when people who have applied in Sept-Nov 08 have started to get a case officer??? I am really frustrated and dont know what to do. Even when I write to ASPC they just say that my case in not allocated. Dont know how much longer I have to wait.

I lodged my application in July 08, meds done feb 09, am on both the CSL and MODL (for some reason), and have a job in QLD, I
was initially told that 4 weeks after meds done, visas will be granted (that was 2 months ago). I have been told that it should
be 2-3 months after meds done that visas will be issued, but to be honest, the goal posts keep changing and I am not going to
hold my breath on this one.

My only comfort on this whole matter, is that I am not alone and by the looks of it, we are all waiting and have been waiting
for a long time.

Some time after 01 July, when they are on top of the CSL applications already on hand, DIAC will get some idea as to how many MODL and non MODL priority applications places they will have for 2009/2010. So they will start to process these two low priority again in the not too distant future. First cabs off the rank will be those applications lodged prior to 01 September 2007 AND those that have already commenced processing - so consider yourself the best of the worst or the first of the last.

I applied under Visa subclass 176 in July 08, the only change Ive seen in my status is from "Your Applications is being processed to
"Being processed further" mails to DIMIAs site are not very helpful either. There is some much confusion that I'm not even sure
if 176 is being processed or not and if yes then which period of applications are being processed at the moment.

Wish the process was just a bit transparent otherwise it makes no sense to have online presence and online visa applications
if all status updates have to be unhelpful system generated auto replies.

What is the status of July 08 176 applications?? Any clue any one

If you are a State sponsored 176 then that would make sense and your application should be with a case officer. If from a high Risk country, they may now be undertaking emplyment checks so it may be a while beofore you get corespondence from them. Has any of your requirements been marked as met are are all documents still showing as outstanding ? Have you already done medicals and polcie checks. If you are not state sponsored but are Family sponsored and on CSL, then these cases are currently being allocated too.

From last many months we have been given the information that
visa priority has been changed.
I am totally in a frustrating state.
Future are on stake .What to do next whether to plan out this or not.
so irritating.

As you say, family sponsored 176 applicants not on CSL or MODL are the lowest processing priority. The problem with this is that nobody knows whether this will mean processing is likely to commence in 6 months, 12 months or even 2 years or more. I am saying to such clients that we have to wait until at least July and probably August before we can get something difinitive from DIAC - they don't know themselves at this point in time. What I would be hoping to get from DIAC by August is something along the lines of - 176 applications like yours will be processed if applied for before say June 2008 and those applied for before January 2009 will be processed in the 2010/2011 program. As long as you know, no matter how long it will be, at least yo ucan then plan around this.

is already submitted to DIAC. and as you know that it will expire in july 10
so in my case when i have already submitted my application to DIAC een then
i have to go for another test of IELTS. Its not my problem man. Why should i appear

The IELTS result does not expire in relation to your current skilled visa application - the requirement is that it must not be more than 2 years old on the day that you apply for your visa - so if they take 6 years to process your application, the IELTS result will always be validfor that particular application.

dear sir, my lodgment date was 27 may 2009, i got the file reference no. and also my file was marked for critical skills list, but on Jun 10, 2009 i got a shocking mail from DIAC saying that my draft is dishonored because of the reason it requires confirmation from the drawer. Now they are asking me to make payment within 5 days otherwise my application will be returned and considered as invalid. i really don't any idea what to do. if somebody gone through the same scenario kindly help me out. i will be obliged.

The overseas draft must be drawn on an Australian bank in Australia. I presume your bank issued the original draft so you need to see if they will re-issue drawing against the Australian bank or cancel and refund so you can go to another bank to issue. Fees are likely to rise to over A$2,500 from 01 July 2009 so you need to sort this out quickly. Also, if it is likely to take a little over the 5 days to sort, advise DIAC within the 5 days and they can hold onto your papers until they receive the new draft.

Your case should not be one for processing at the moment, it is possible that it was actioned as a possible CSL priority and then they may realise that the IELTS score is not good enough and suspend processing on it. I think yo ushould assume that yoru application will not be processed for some time and maybe another IELTS test should be attempted if you want it processed quicker.

Unless he holds a UK or other acceptable passport, he will have to sit IELTS before lodging his visa application as he needs to have a minimum 6 in each IELTS at time of application or a minimum 5 in each IELTS if a tradesperson (ASCO 4XXX, at time of application. It is possible to lodge the visa application after sitting the IELTS test and before teh results are receievd but if the required IELTS is not scored, teh application will be refused without any refund.

Apply on-line before 01 July 2009 if you already have a valid minimum 6 IELTS score. Your application may sit there for a year or more but you can get priority processing at any time during the application either through State Sponsorship or gaining a minimum 7 in IELTS.

It varies but when the yask for medicals the yare actively processing your file and will grant visa as soon as possible UNLESS you were a CSL case when the yasked for teh medicals and you drop off the CSL before they grant your visa.

1. I got state sponsorship on 19 feb'09
2. I applied online on 2nd march'09 to Diac with all necesary documents and fees
3. I received msg.from state that they had send form 1100 to diac on 11th june

When they allocated CO and how i come to know that they allocated CO, as my status is not changes yet.

That is a big delay in getting the form 1100 to them. As it is near the end of the program year, give them until second week of July to show some activity with yoru case. If nothing by then, send a polite enquiry asking them to confirm you are receiving priority processing.

Hi Neha

The Form 1100 can come in any time before they make a points assessment of your case. Applications without the 1100 ate processed as 175 vsia applications and as long as they score at elast 100 points (without State Sponsorship) they will at least be pooled. If the form 1100 comes in after an application is pooled, it can then commence being processed as a 176 visa - all 175 applicatiosn are also applicatiosn for 176 visas and vice versa.

As long as you passed an IELTS at the required level prior to your visa application (but not more than 2 years prior) and your experience is assessed as skilled and covers the required periods, there is not much that can go wrong with your application - It is just a matter of when.

Dear Tony,

Thanks a lot your fast response to my worries.

In brief my case is as follows.

We have placed file under my husband's name on 2nd March 2009 and all documents except my IELTS result and medical papers ( applicant's wife IELTS RESULT ) attched with on line application with in specified time by DIAC. ( which includes all personnel documents along with State Sponsorship letter ).

But till date we have not received any mail from DAIC regarding allocation of case officer and also on line visa status inquiry documents check list still showing " REQUIRED " status against each and every documents name.

My question is that when will status of documents change ?
and total time required to get the visa in this case if I'm from high risk country ( India ) ?

The "REQUIRED" status for documents does not change until a case officer assesses and confirms they are held. Processing of your case has been delayed due to the only recent receipt of the Form 1100 by DIAC. All sounds perfectly OK and you should just wait a couple of weeks to hear something or then follow-up.

If you are state sponsored 475, they will be processing your case as fast as they can. processing times can vary if they are waiting on security checks and/or employer checks. I encourage applicants not to chase at this point in time as it is a busy period fro DIAC wit hthe end of the program year a week away. Give it a coupleo f weeks in July and if you can see no progress, send them a Postlodgement Enquiry.

Hi Tony: A slightly delayed reply from my end: My application under 176 is family sponsored and neither state sponsored nor on CSL etc etc. So i guess this is going to take really really long to process.

I'm from India and hence not sure if it is considered as a High risk country, maybe you could throw some light on this.
It shows all documents as Outstanding and not as MET, what does that mean?
Haven't got any Police or medical checks done as yet as we were advised so by DIMIAS' customer service. I was advised that I should not get this done unless the case officer asks us to do so.

What would be your estimation on my case? Thanking in anticipation

So you are in the unfortunate lowest priority. Latest we have is that DIAC think none will commence processing in next program year - so nothing until July 2010 at earliest. Eventual processing time will depend on the Australian economy which is predicted to improve in 12 months. Status of docuemnts will show as Outstanding eventhough uploaded to your application, until you get a case officer.

They certainly do refuse cases - can be because IELTS was not done before applying or they assess that the work is not "skilled" after an employer check. DIAC should put any adverse information to you but if they decide that your experience is not skilled, the first you may hear is a refusal. Accountants may be recognised as accountants but their actual job duties may be at a much lower skill level and DIAC can sometimes decide that you are workin gas a "Bookkeeper" or some other occupation that is not on the Skilled Occupations List. The criteria for visas is quite clear but the one variable is how DIAC assess your experience and is usually the only place where you can get refused - assuming you have done the obvious things right.

on 16-06-2009 when no update was received from case officer, we made PLE. reply was dated 22-06-2009 stating that "Your file is currently with your case officer for further processing. If your case officer requires any additional documentation/information to assist in the processing of your visa application they will contact you shortly."

today, 27-06-2009, still no communication from CO.
what could be holding CO from finalising my grant? is there still a chance that i will be refused a visa (God forbid).

i know of another applicant in same case as mine (176/Accountant/WA) required Health Undertaking in 15-05-2009 visa grant 09-06-2009.

They told me that they have successfully received payment via credit card. I requested them to return my draft dat was dishonored. Generally a bank draft would not be dishonoured but there is a problem if the bank draft is not drawn on an Australian branch of an Australian bank. So I ma thinking this is what has happened with your case. I presume you need the original to speed up a refund of that draft so you should be hasseling DIAC weekly until they confirm they have sent it back to you.

If it was anonymous adverse information they received, they should put this to you for a response however, if, for example, as a result of an employer check they decide that your experience is not "skilled", they often just refuse the case and that is the first you hear about it.

Your case should be processed within 7 months from what you have said although delays can occur when doing employer and/or Security checks. If you have a cse officer the nall would appear to be proceeding for you - if you do not have a case officer, you should have one so contact them to enquire.

It sounds like yours may be granted in record time unless the securit checks hold it up. Visa will be granted as soon as all requirements are met - 7 months is more of an average service level, many take longer as some applicants are slow to respond to information requests etc.

The delay is not unusual - DIAC could be doing some checks. In cases like this DIAC advise us not to re-chase for information on a case unless 2 months has passed without any obvious progress/communication with your case. So it is tough to wait another month but in 1 month time, if you have not heard anything, you can send a PLE to DIAC styating that you have heard nothing on your case for 2 months and that you were advised that you should enquire if such a period of inaction occurs.

Your case is high priority so they will grant your visa as quickly as they can. They have to do whatever checks they have to do and this can delay the approval. Refusal by UK will not affect your visa application nor will previous non-use of Australian student visa.

DIAC have advised that they are unlikely to commence processing of any cases that are not State sponsored or on CSL, for at least another 12 months. So the only way to speed up your case is to obtain State Sponsorship OR find an employer who is willing to ENS or RSMS sponsor you. If you do find such an employer, the fact that you have an 886 application being considered means that you do not need to pay the VISA application fee for the ENS/RSMS application, currently A$2,525 on-shore.

You need to confirm that Victoria have sent the Form 1100 to the ASPC and then give them a minimum of 4 weeks to allocate a case officer (they say they will allocate within 10 days of receiving the Form 1100). If no sign online that you have a case officer after that time. send PLE to confirm that you now wish to be processed as a State sponsored case.

Case officers are only human and they do some things differently to each other. We process nearly a thousand applications a year and some do show up as a bit more painful in their document requests but nothing so bad that you would try to avoid them (if you could). We would not be comfortable in releasing names of case officers as it would not be fair on them and we would be open to a law suit.

Hi, Sir.
I'm very sorry if I sounded rude or impolite. just that when I received pregrant 15-05-2009 and was able to comply with the only requirement (passport details), I already made certain moves like no longer enrolling my kids, selling some property in preparation to buying air tickets, house rental in OZ, hoping that it wouldn't take that long for the grant.
Now that it's nearly 2 months after, I am in limbo. Others that were allocated to case officers later than me already got their visa. It's like being given the high hopes then dropped like hot potato.
Please bear with my frustration. I don't know someone who can empathize with my situation other than someone with an idea on the process.

Hi Maruf

A dental surgeon can nominate the easier skills assessment from VETASSESS as a Medical Administrator and would score less points for this. This is bacause VETASSESS only look at the level of the qualification and not the relevance to the nominated occupation. State sponsorship for 475 generally requires an approved skills assessment and 12 months of skilled experience in ANY SOL occupation. So there is a problem that VETASSESS approves applicants who may have no chance of performing the duties of the approved occupation. DIAC have the power to refuse to approve a state sponsorship but hopefully, in your case, they will see some connection between your experience and the nominated occupation or just simply overlook it.

the applicant has been EMPLOYED in a SKILLED OCCUPATION for at least 12 months in the period of 24 months ending immediately before the day on which the application was made.

EMPLOYED means: engaged in an occupation for remuneration for at least 20 hours weekly.

SKILLED OCCUPATION means: an occupation listed on the SOL

The employer checks vary greatly with Geography - as in how far away your work is from the Australian overseas mission. Security checks are also difficult to predict and vary greatly. If things go quiet for 8 weeks, you are entitled to request an update from Immigration.

As a proof of relationship I will provide my birth certificate. But by mistake the mother's name in my certificate became little different than that of my brother's.

However, the father's name is exactly same. I also have my name into my brother's application when he applied for the PR.

Will there be any problem if I apply with my current mother's name?

Even if you had different mothers and the same father, your brother would still eb able to sponsor you as your half-brother - so it is not a crucial issue and, as such, Diac may not even query it - it is quite common to have different variations of a name on such documents.

Hi Polen

You are correct - VETASSESS wil lapprove you for any of their listed 50 point occupations on the strength of ANY degree equivalent qualification. VETASSESS are currently reviewing their assessment procedures so that some relevancy between the qual or experience is necessary. I can't see this changing this calendar year. Where you use a 50 point occupation as you only need 100 points due to a relative sponsorship, then this is a safe strategy. Where you use the 50 point to gain 176 or 475 state sponsorship, there is always the danger that DIAC may not approve the State Sponsorship if your qualifications and experience bare no resemblance whatsoever to your nominated occupation.

Thanks for the reply..you mentioned that there is always the danger that DIAC may not approve the State Sponsorship if your qualifications and experience bare no resemblance whatsoever to your nominated occupation. but as far as i know that to meet the recent work experience requirement of DIAC an applicant needs to work in an occupation listed on SOL. so, why DIAC may not approve the state sponsorship if i work in any occupation listed on SOL (which might not be my nominated occupation)

A security check is where the Australian Security Agency is asked to give you security clearance. They may do this without referral to any other agency OR, depending on your profile/name. If the ydecide to check overseas, then this can delay the security clearance getting back to DIAC.

The State Sponsorship is a huge concession on the Independent 175 visa - effectively a pass-mark 30 points less AND Priproity processing. This concession is based on an identified local shortage in a particular skill. Most States/Territories assume that as you have been approved by VETASSESS then you have relevant quals and/or skills. Due to the illogical way VETASSESS operate, this has created a big loophole in the system in relation to State Sponsorship. There is another requirement of the 176 visa and that is that DIAC have approved your State/Territory Sponsorship. They do not have to accept it just because the State or Territory has approved it.

Having said that, I would be hopeful that the ywould see some connection between say a Medical Practictioner or a Dentist and a Medical Adminstrator.

pls bear with me. i have another question. sadly, i still don't have my visa after 8 weeks of pre-grant letter.
is it ok if my children (ages 18 & 17 by aug) find jobs during the waiting period? wouldn't it affect their being my dependants in my application?

Technically they must be dependent on the day the visa is approved - not a problem for the 17 year old as long as he/she does not turn 18 before the grant of the visa. Your 18 year old should not work until the visa is granted. If your 18 year old is found by DIAC to be working (Highly unlikely I know) you could still argue that she is dependent as long as she is not earning enough to pay for her accommodation food and clothes. But you are this close to getting the visas that I would not jeopardise anything at this stage.

I have heard of some CSL cases, that were recently lodged, being allocated a case officer very quickly. This is quite common when DIAC is working through a backlog, new ones that come in get allocated immediately while they work their way through the backlog in date received order.

If it is already achieved without "Occupation in Demand" point, Should I go for it?

Hi Mandal

If you are 176 sponsored, whether State or family, you may not need MODL points. To score MODL points DIAC need to find that you have at least 12 montsh experience in the previous 4 years in the Nominated MODL occupation (or closely related Occupation).

This may be assessed if you are family sponsored 176 as the MODL gives slightly higher priority. If you are State sponsored, the MODL points and priority are irrelevant.

Yes, if accepted as your dependent, your mother would need to prove that she has functional English or you would have to pay the English Language Tuition charge.

For DIAC to accept your mother as your dependent for this visa, you would have to evidence that your mother:

. is a widow or divorcee and not currently in a Spouse relationship with another person
. is financially dependent on you for a substantial period

A substantia period is usually 3 years (but can be less in certain circumstances).

Financially dependent means that you pay for her housing, food and clothes i.e. the essentials.

So any documenst that evidence the above should be included with the form 47A.

i am a Dentist from bangladesh and i would like to assess my skill. i printed out ADC assessment form. i want to pay the assessment fee (AUD530) via credit card. i have no crdit card of my own so i want to use my brother's credit card who lives in japan. my brother wants to print out the payment section and then after filling the credit card information,signing it he will send me the scaned copy of that page. i will print out the scanned copy of that page and attach it with the rest of the pages of the application. Now my question is will ADC accept it & proceed the transection?

I am not sure that ADC will accept a scanned authority for payment. either check with the direct OR send all to your brother and he ca nsign the original application form payment authority and send it direct to the ADC from Japan.

Functiona lEnglish must be proved in one of the following ways:

• A completed IELTS test with a band score of at least four and a half (4.5) based on all four components being a total score of at least 17.5; OR
• Evidence of an award of a trade certificate or higher qualification, that required at least 2 years of full-time study where the instruction was in English;OR
• Evidence of completing all primary and at least 3 years secondary education at educational institutions in which all instruction was in English; OR
• Evidence of completing at least 5 years secondary education at educational institutions in which all instruction was in English; OR
• Evidence of completing, in Australia, at least 1 year full-time study, or equivalent part-time study, towards a tertiary qualification at educational institutions where instruction was in English.

Note: Should any secondary applicant(s) be unable to evidence functional English through the above means, then you can choose to pay the second instalment visa application charge towards their English language training in Australia

When I worked there over 13 years ago, things were sent by Diplomatic bag and took the best part of 2 weeks to get back to a case officer. I am not sure but I presume they scan/Email these days. I reckon your case will take well less than 7 months.

or,

# Make copies of the document, certify by proper authority then scan & send.

or,

If there is some colour in the original document (other than black) you can scan the original document in colour. If the original documen tis just black and white, you will need to get it properly certified with some colour in the certification and then scan the certified copy in colour.
